1. Agreement
1.1 These terms form a binding agreement between MyIceland and the business that subscribes to or uses the Service (“the Operator”). By creating an account, subscribing, or using the Service, the Operator accepts these terms and the accompanying Data Processing Agreement.
2. Definitions
- Service: the MyIceland customer self-service portal and related software, hosting, and features.
- Operator: the business (e.g. a tour operator) that subscribes to the Service.
- End Customer: the Operator’s own customers (travellers) who use the portal to view and manage their bookings.
- Booking Platform: the third-party booking system (Bókun) that holds the authoritative booking records.
- DPA: the Data Processing Agreement governing personal data processed on the Operator’s behalf.
3. The Service
3.1 The Service provides a white-labelled portal that lets the Operator’s End Customers view, manage, and modify their bookings and browse additional tours. The Service integrates with the Booking Platform and relies on it for booking data and payment processing.
3.2 The Service is provided to businesses only. The Operator must be a business and the person accepting these terms must be authorised to bind that business.
3.3 We may improve, change, or discontinue features of the Service. We will give reasonable notice of material adverse changes.
4. Accounts
4.1 The Operator is responsible for the accuracy of its account information, for keeping its credentials and API keys secure, and for all activity under its account.
4.2 The Operator is responsible for the configuration choices it makes in the Service, including branding, content, tour selection, and any customer-facing copy it authors.
5. Fees and billing
5.1 The Service is provided on a subscription, per Operator, invoiced in advance. The Operator chooses one of two billing periods:
- Monthly: 23.900 ISK per month.
- Yearly: 238.800 ISK per year, the equivalent of 19.900 ISK per month.
Prices exclude VAT (VSK). VAT at the applicable rate, currently 24%, is added to each invoice. There is no commission and there are no per-booking fees.
5.2 Founding price. An Operator that subscribes while the prices in clause 5.1 are offered as the founding price keeps them for as long as its subscription continues without interruption, on either billing period. The founding price ends if the subscription is cancelled or ends for non-payment. A later subscription is at the prices offered at that time.
5.3 Renewal and cancellation. Subscriptions renew automatically at the end of each billing period (month or year) unless cancelled. The Operator may cancel at any time, effective at the end of the current billing period. Except under clause 5.4, fees already paid for the current period are not refunded, in full or pro rata.
5.4 30-day money-back guarantee. If the Operator cancels within 30 days of its first payment, MyIceland refunds that payment in full, including VAT, on either billing period, and the Operator’s access ends on cancellation. The guarantee applies once per Operator.
5.5 Changing billing period. The Operator may move from monthly to yearly billing at any time, taking effect from its next billing date, and from yearly to monthly when its paid year ends.
5.6 MyIceland is never the payment processor for End Customer transactions. All End Customer payments are handled by the Booking Platform’s payment provider. MyIceland does not collect, hold, or process End Customer card or bank details, and does not earn commission or transaction fees on bookings.
6. Acceptable use
6.1 The Operator must not: use the Service unlawfully; attempt to breach, overload, reverse-engineer, or circumvent the Service or its security or rate limits; use it to infringe others’ rights; or misuse End Customer data.
7. Intellectual property
7.1 MyIceland retains all rights in the Service, its software, and its underlying design and branding. Nothing in these terms transfers ownership of the Service to the Operator.
7.2 The Operator retains ownership of its own content, branding, and data it provides. The Operator grants MyIceland the licence necessary to host and display that content for the purpose of providing the Service.
8. Third-party services
8.1 The Service relies on third parties, including the Booking Platform (Bókun) and its payment provider, hosting (Railway), email delivery (Resend), and, for tickets that End Customers add to Apple Wallet, Apple (Apple Wallet and Apple’s push notification service). These have their own terms, and their availability is outside MyIceland’s control. The Operator is responsible for maintaining its own account and agreements with the Booking Platform.
9. Data protection
9.1 Personal data that MyIceland processes on the Operator’s behalf is governed by the DPA, which forms part of these terms. The Operator is the controller of its End Customers’ data and is responsible for informing its End Customers about how their data is processed, including naming MyIceland as a processor where required.
10. Disclaimers and limitation of liability
10.1 The Service is provided “as is” and “as available” to the fullest extent permitted by law. MyIceland does not warrant that the Service will be uninterrupted, error-free, or free from data loss, and does not guarantee any particular uptime unless separately agreed in writing.
10.2 To the fullest extent permitted by law, MyIceland is not liable for indirect, incidental, consequential, or special losses, including loss of profit, loss of bookings, loss of revenue, or reputational harm, arising from the use of or inability to use the Service.
10.3 To the fullest extent permitted by law, MyIceland’s total aggregate liability to the Operator arising out of or in connection with the Service in any 12-month period is limited to the total fees paid by the Operator for the Service in that period. This cap does not apply to liability that cannot be limited under applicable law.
10.4 Nothing in these terms excludes liability that cannot be excluded under applicable law.
11. Term and termination
11.1 Either party may terminate at the end of the current billing period. MyIceland may suspend or terminate access for material breach of these terms.
11.2 On termination, the Operator’s access ends and personal data is handled as set out in the DPA (deleted or returned within 30 days unless law requires retention).
12. Changes to these terms
12.1 We may update these terms. We will give reasonable notice of material changes, and continued use after the effective date constitutes acceptance. A change to these terms never raises the price of an Operator that keeps the founding price under clause 5.2.
13. Governing law and disputes
13.1 These terms are governed by the laws of Iceland, and the Icelandic courts have jurisdiction.
